Returns, Complaints, and Cancellation of the Contract
Definitions
Seller: Podlaski Gabinet Numizmatyczny Marek Melcer - PGNUM, registered in the business register by the Mayor of Białystok under registration number 54670, Tax ID (NIP) 542-237-50-67, National Business Registry Number (REGON) 050676900, PL 15-097 Białystok, ul. Marii Skłodowskiej-Curie 16.
Buyer: Customer (PGNUM Website User)
Contract: The agreement is concluded when the Buyer (User) accesses the PGNUM Website, reviews the commercial offer, submits an order, which is then fulfilled by the online store (Civil Code).
Complaints and Withdrawal from the Contract
Within 14 days of receiving the purchased item after the contract is concluded, the Buyer (User) may withdraw from the contract without providing any reason (Legal basis: Articles 27–29 of the Consumer Rights Act). To withdraw from the contract, you must submit a statement of intent (https://uokik.gov.pl/downloadId/1216) by emailing sklep@pgnum.pl or by mail to the company’s address. If the withdrawal from the contract is sent electronically, the Buyer will receive a return email confirming its receipt (Legal basis: Article 30 of the Consumer Rights Act). In accordance with the Consumer Rights Act of May 30, 2014, the Seller ACCEPTS returns of Goods whose price DOES NOT DEPEND on fluctuations in the financial market over which the business has no control and which may occur before the expiration of the withdrawal period. In accordance with Chapter 5, Article 40(6), the Legislator has classified goods purchased in the form of gold and precious metals, as well as gold and silver coins and bars, as items NOT COVERED by the Buyer’s (Consumer’s) right of withdrawal (Legal basis: Article 38 of the Consumer Rights Act).
In the event of an unjustified complaint or damage to the goods caused by the Buyer (User), all costs shall be borne by the Buyer.
Refund Policy
The refund will be issued to the bank account number provided by the Buyer within 14 days of receiving the item and the notice of withdrawal from the transaction. The Buyer may withhold the refund until the returned item is received or confirmation of its return is provided—whichever occurs first (Legal basis: Article 32 of the Consumer Rights Act). In addition to the equivalent of the price of the goods, the Seller shall reimburse the Buyer (Consumer) for the costs of delivering the ordered goods to them—up to an amount corresponding to the cheapest shipping option available in the given offer (Legal basis: Articles 33 and 34(2) and (4) of the Consumer Rights Act).
The Buyer (Consumer) is required to return the goods immediately, no later than within 14 days from the date on which they submitted the notice of withdrawal from the contract (Legal basis: Articles 32, 34(1) and (3), and Article 37 of the Consumer Rights Act).
In the event of withdrawal from the Contract, the Seller shall not bear the cost of returning the Goods. The Buyer (Consumer) covers all direct costs of returning the goods (e.g., costs of packaging, securing, and shipping), unless the seller: has agreed to bear them or has not informed the buyer of the need to bear them (Legal basis: Articles 33 and 34(2) and (4) of the Consumer Rights Act).
Furthermore, the Consumer Rights Act does not apply—and thus the right of withdrawal does not apply either—to contracts concluded outside of business premises, e.g., in online stores, if the consumer is required to pay an amount not exceeding fifty zlotys (Legal basis: Article 38 of the Consumer Rights Act).
In matters not covered by the PGNUM Website Terms of Service, the provisions of Polish law shall apply. Any disputes related to the services provided by Podlaski Gabinet Numizmatyczny Marek Melcer shall be resolved by the competent Polish common courts.
